1. Preamble
These Terms and Conditions of Use and Sale (hereinafter "Terms") govern the relationship between:
- iStore36, an independent online boutique operating the website istore36.com, hereinafter referred to as "the Seller" or "iStore36";
- and any adult natural person making a purchase on the site, hereinafter referred to as "the Customer."
Any order placed on the site implies unconditional acceptance of these Terms. The Customer is invited to read them carefully before placing an order.
2. Purpose
iStore36 offers digital subscriptions providing access to streaming services. These subscriptions are provided by third-party operators. iStore36 acts as an independent distributor and does not control the content, availability, or quality of the services offered. iStore36 is neither the owner, publisher, nor producer of the content accessible through the offered subscriptions.
3. Products and Services
3.1 Product Description
Each subscription is described on its product page with the following characteristics: duration, number of allowed devices, features, and price. Images and descriptions are provided for informational purposes only. The Customer must verify their device compatibility before placing an order.
3.2 Availability
Offers are valid while supplies last. If a product becomes unavailable after an order is placed, the Customer will be informed and may request a refund or a replacement product.
4. Pricing and Payment
4.1 Pricing
Prices are displayed in Moroccan Dirhams (MAD) and may be modified at any time. The applicable price is the one in effect at the time the order is confirmed. Prices do not include VAT, as iStore36 is not subject to VAT.
4.2 Payment Methods
Payment is made online using the methods available at checkout (credit card, digital wallet, or other available options). The order is only processed after payment confirmation.
5. Ordering and Delivery
5.1 Order Process
- Select the product and add it to the cart.
- Review the cart and enter order information.
- Complete online payment.
- Receive order confirmation by email.
5.2 Delivery of Access Codes
Access codes and credentials are delivered electronically (by email and/or in the customer account area) after payment validation. Processing time is generally a few minutes to a few hours, depending on order volume and automated verification checks. In some cases, processing may take up to 24 hours. No physical items are shipped ? all products are 100% digital and delivered electronically.
6. Right of Withdrawal and Refunds
In accordance with applicable law, the right of withdrawal does not apply to digital products whose performance has begun with the Customer's consent. By placing an order, the Customer acknowledges and agrees that the provision of access codes constitutes a fully performed digital service upon delivery of the credentials.
Refund requests are reviewed on a case-by-case basis in accordance with our Refund and Cancellation Policy.
7. Customer Obligations
The Customer agrees to:
- Provide accurate and complete information when placing an order.
- Not use the service for illegal or unauthorized purposes.
- Not share, resell, or redistribute the provided credentials.
- Comply with the third-party service provider's terms of use.
8. Liability
8.1 Limitation of Liability
iStore36 strives to keep the site and services accessible at all times but cannot guarantee uninterrupted availability. iStore36 shall not be held liable for:
- Interruptions, outages, or maintenance of third-party servers.
- Modifications or discontinuation of services by third-party operators.
- The quality, stability, or content of streams provided by third-party operators.
- Incompatibility with the Customer's equipment that was not verified beforehand.
8.2 Force Majeure
Neither party shall be held liable for failure to perform its obligations if such failure results from a force majeure event as defined by case law.
9. Intellectual Property
The website istore36.com, its graphic design, source code, and editorial content are the exclusive property of iStore36. Any reproduction or use without authorization is prohibited.
10. Personal Data
The Customer's personal data is processed in accordance with our Privacy Policy. The Customer has the right to access, rectify, and delete their data by writing to support@istore36.com.
11. Changes to the Terms
iStore36 reserves the right to modify these Terms at any time. The applicable version is the one in effect at the time of the order. Changes take effect upon publication on the site.
12. Applicable Law and Disputes
These Terms are governed by Moroccan law. In the event of a dispute, the parties shall endeavor to reach an amicable resolution before any legal action. Failing that, the dispute shall be brought before the competent courts.
